التخصيص بالتقرير عند الأصوليين وتطبيقاته الفقهية

ملخص البحث:
يبين البحث أن تقرير النبي H يُخرج من العام ما قرره النبي H، غير أن الجمهور يقولون: إن ذلک تخصيص مطلقاً، سواء أکان مقارناً أو متأخراً، أما الحنفية فيقولون: إن کان علم النبي H بالفعل في مجلس ذکر العام فهو مخصص، وإن لم يکن علمه في مجلس ذکر العام بل کان متأخراً فهو نسخ. وفرق بين أن يخالف ذلک التقريرُ جميعَ ما دل عليه العام، وبين أن يخالف بعض ما دل عليه؛ فالأول يکون نسخاً، والثاني يکون تخصيصاً. ويهدف البحث إلى ما يلي: أولاً: بيان مفهوم التخصيص عند کل من الحنفية والجمهور. ثانياً: بيان خلاف الأصوليين في تخصيص العام بتقرير النبي H. ثالثاً: التأکيد على تعدية التخصيص بالتقرير لغير المُقَر له من عامة الأمة. ومن أهم نتائج البحث ما يلي: أولاً: يعد التقرير أصلاً من الأصول التي يستند الفقهاء إليها في استنباط الأحکام الفقهية. ثانياً: أن تقرير النبي H يجوز التخصيص به، ولا يتأتى تخصيصه؛ لانتفاء عمومه. ثالثاً: يعد التخصيص بالتقرير من المخصصات المنفصلة. رابعاً: أن التخصيص بالتقرير يتعدى حکمه إلى جميع الأمة.
