الخبر المشهور وأثره في الفروع الفقهية عند الحنفية

ملخص البحث:
هذا البحث بعنوان (الخبر المشهور وأثره في الفروع الفقهية عند الحنفية)، وقد ضمنته الکلام في تمهيد وعدة مطالب، وکان الکلام في التمهيد عن السنة، من حيث تعريفها وأقسامها، ثم أتبعت ذلک بتعريف الخبر، وأقسامه باعتبار الاتصال بالنبي صلى الله عليه وسلم، ثم تناولت الکلام عن السنة المشهورة عند الأصوليين والمحدثين، من حيث تعريفها، و نشأة مصطلح الشهرة، و حکم السنة المشهورة، وحکم منکرها، والعلاقة بين المشهور والمستفيض، و موقف فقهاء المذاهب من ضابط تلقي الأمة للخبر بالقبول، و قد تفرد الحنفية کمذهب بذکر الخبر المشهور دون غيرهم من المذاهب الأخرى، ويرجع السبب في ذلک إلى شدة اعتنائهم بمراعاة مراتب الأدلة في استنباط الأحکام، وکان ختام هذا البحث بيان الأثر الأصولي والفقهي للخبر المشهور، وذکر بعض الفروع الفقهية للسادة الحنفية المدونة في کتبهم واستدلالهم ببعض الأخبار التي ذکروا أنّها من المشهورات، وسبب ذلک، وکيفية التعامل معها عند معارضتها للقرآن والأحاديث الأخرى.
Abstract:
This research was titled (The well known Hadeeth and its Impact on the Jurisprudential Sections). It has included a preamble and several demands. The discussion in the preamble was about the Sunnah in terms of its definition and divisions. Then I followed that up with the definition of the well-known Hadeeth and its sections on the basis of contacting to the Prophet, (peace and blessings be upon him). After that I dealt with the famous Sunnah among fundamentalists and modernists in terms of its definition the emergence of the term fame, the provision of the famous Sunnah, the provision on its denial, the relationship between the famous and the extensive and the nation’s acceptance of the well known-Hadeeth and the Hanafi school has been singled out as a doctrine by mentioning the well-known Hadeeth without other schools of thought. reason for this is due to their concern with observing the ranks of evidence from the strength in establishing provision .The conclusion of this research was to show the jurisprudential impact of the well-known Hadeeth and mentioning some jurisprudential branches of Honoured Hanfis which were written in their books and their inference with some Hadeeths which they mentioned as well known ones, the reason for this and how to deal with it when opposing the Qur’an and other hadiths.
