مطالبة النافي بالدليل دراسة أصولية تطبيقية

ملخص البحث:
هذا البحث في مسألة من أهم مسائل علم أصول الفقه، وهي مطالبة النافي بالدليل، وتظهر أهمية هذا الموضوع فيما يلي: الوقوف على طرق الاستدلال على الأحکام الشرعية نفياً أو إثباتاً ، نظراً لتباين مناهج العلماء في ذلک، وکذلک بيان حقيقة الاستدلال بعدم الدليل على عدم الحکم ، من حيث الاکتفاء بمجرد النفي على عدم وجود الحکم، وکذلک مدى اعتبار فقدان الدليل بعد طلبه مثبتاً لعدم الحکم، وکذلک بيان جدة الموضوع حيث لم أقف على دراسة وافية تناولت مطالبة النافي بالدليل تأصيلاً وتطبيقاً، وکذلک الربط بين التأصيل والتطبيق ، يظهر حقيق أثر الخلاف في القاعدة في الفروع وينکشف زيف مالا أثر له. وقد حرصت في هذا البحث على بيان نوع الخلاف وثمرته المترتبة عليه مع الحرص على بيان وجه ارتباط الفرع بأصله ليظهر حقيق أثر القاعدة في الفرع وينکشف زيف مالا أثر له .
 
Abstract:
This research is about one of the most important issues of the science of fundamental of  jurisprudence which is the  request of the negator for evidence and the importance of this topic is shown in the following: Knowing the methods of Heuristics (inference) on the legal provisions  negatively and positively, regarding varied approaches of scholars in this as well as stating the fact of Heuristics that there is no evidence for non-judgment In terms of being satisfied with the mere negative of the absence of the ruling as well as the extent of the loss of evidence after his request confirming the lack of judgment as well as indicating the novelty of the subject as I have not come across a comprehensive study that dealt with the request of the negator with evidence in its origin and application as well as the link between rooting and application reveals  the reality of the impact of the disagreement on the rule and that appears in the branches and the falsehood of non-effect is revealed. I have been keen in this research to explain the type of conflict and its fruits resulting from it with being careful to clarify the aspect of the  connection branch’s of its origin in order to reveal the true effect of the rule in the branch and to reveal the falsehood of what has no effect.
