مسائل الفقه عند معاوية رضي الله عنه دراسة فقهية مقارنة

ملخص البحث:
يأتي هذا البحث (مسائل الفقه عند معاوية رضي الله عنه دراسة فقهية مقارنة) وهو دراسة للجانب الفقهي عند شخصية شغلت العالم الإسلامي حوالي عشرين عاما أميرا للشام، ومثلها خليفة للمسلمين، وقد أصدر اجتهاداته وهو إمام المسلمين مما يعطي لاجتهاداته جانبا مهما، ومن هنا تأتي أهمية هذا البحث، سيما أن معاوية-رضي الله عنه- تمت دراسته من جوانب کثيرة ما عدا الجانب الفقهي عنده، وتکمن مشکلة البحث أن هذه الاجتهادات الفقهية ليست مجموعة بل مبثوثة ومتناثرة في بطون الکتب الفقهية، وتحتاج إلى جمع وتثبت ودراسة، وهذا ما قام به البحث في بعض أبواب الفقه، وقد اعتمد الباحث على المنهج التحليلي المقارن لبيان رأي معاوية في المسائل الفقهية، ثم المقارنة بين رأيه ورأي غيره من الصحابة، وبيان الراجح منها، وقد جاء البحث في مبحثين تسبقهما مقدمة وتمهيد، وتليهما خاتمة وفهارس، أما التمهيد فقد تحدثت فيه عن ترجمة موجزة لمعاوية-رضي الله عنه-  ثم المبحث الأول لمسائل الفقه في باب العبادات، ثم المبحث الثاني لمسائل متفرقة من أبواب الفقه، ثم الخاتمة وقد دونت فيها أهم النتائج التي توصل اليها الباحث، وأخيرا جاءت الفهارس التفصيلية للبحث.
 
Abstract:
This study (Issues of Jurisprudence for Muawiyah - may God be pleased with him - a comparative jurisprudence study) comes as a study of the jurisprudential aspect of a figure who has occupied the Islamic world for about twenty years as the ruler of the Levant, and the like of whom is a caliph of the Muslims, and he issued his jurisprudence and he is the Imam of Muslims, which gives his jurisprudence an important aspect, hence The importance of this research comes, especially since Muawiyah - may God be pleased with him - has been studied from many aspects, except for the jurisprudential aspect of it, and the problem of the research is that these jurisprudential jurisprudence is not a group but is transmitted and scattered in the stomachs of jurisprudential books, and it needs to be collected, confirmed and studied, and this is what was established. The research in some chapters of jurisprudence, and the researcher relied on the analytical and comparative method to clarify Muawiya’s opinion on jurisprudential issues, then compare his opinion with the opinion of other companions, and indicate the most correct of them. The research came in two papers preceded by an introduction and preface, followed by a conclusion and indexes, while the introduction has been made. In it I talked about a brief translation of Muawiyah - may God be pleased with him - then the first topic of matters of jurisprudence in the section of worship, then the second study of separate issues from the chapters of jurisprudence, then the conclusion and I recorded the most important results reached by the researcher, and finally came the detailed indexes for the research.
