لغة الإشارة وأثرها في فقه الأخرس - دراسة فقهية

إن من المقاصد السامية للشريعة الإسلامية التيسير ورفع الحرج والضيق عن الناس , والمساهمة في تقديم ما يعود بالخير والنفع علي البشرية جمعاء في الدنيا والآخرة , ولما کانت الشريعة الإسلامية تهتم بذوي الاحتياجات الخاصة وکان من بين فئات المجتمع فئة خاصة حرمت نعمة النطق وهم في حاجة ماسة لبيان شاف لکل الأحکام المتعلقة بهم وتقديم کل ما يمکن تقديمه لهم حتي لا يشعروا بالعنصرية ويتمکنوا من التعايش مع المجتمع , فلذا أردت - بعون الله تعالي - أن أکتب بحثًا أتحدث فيه عن لغة الإشارة وأثرها في فقه الأخرس  وذلک لما " للغة الإشارة  " من أهمية بالغة في حياة الأخرس , وتأثير فعال علي الکثير من أحکامه الفقهية والتي لا يستغني عنها في حياته اليومية خصوصًا مع تطور هذه اللغة وإنشاء العديد من المدارس والجامعات والتي تعني بتدريس الإشارات والعلوم الأخرى , کما أنه يمکن من خلال لغة الإشارة الوصول إلي الاتفاق في کثير من المسائل الخلافية التي تتعلق بأحکام الأخرس , وقد اشتملت خطة هذا البحث علي مقدمة, وثلاثة مباحث , وخاتمة , أما    المقدمة : فقد تعرضت فيها لذکر أهمية هذا الموضوع , وإشکالية الدراسة  والجهود السابقة في هذا الموضوع, وفي المبحث الأول : تحدثت عن مفهوم لغة الإشارة وذلک في ثلاثة مطالب, وفي المبحث الثاني : تحدثت عن أهمية لغة الإشارة وتاريخها وضوابطها وذلک في ثلاثة مطالب , وفي المبحث      الثالث : تحدثت عن أثر لغة الإشارة في فقه الأخرس وذلک في مطلبين , وفي الخاتمة : لخصت أهم النتائج التي توصلت إليها من خلال البحث
Abstract:
One of the supreme intentions of Islamic jurisprudence is to facilitate and remove embarrassment and distress from people and to contribute to the presentation of what is good and beneficial for all mankind in this world and the hereafter.
  And since Islamic law is concerned with people with disabilities and among the factions of society was a special faction that prohibited the grace of utterance who  are in dire need of a statement  for  all the provisions related to them and providing them with everything that could be offered to them so that they would not feel racist and be able to coexist with society,  I wanted -with the help of God Almighty - to write a research in which I am talking about sign language and its impact on the jurisprudence of  the dumb because of the great importance of “sign language” in the life of the dumb, and its effective influence on many of his jurisprudential provsions that are indispensable in his daily life especially with the development of this language and the setting up of many schools and universities which are concerned with teaching signs and other sciences. It is also possible through sign language to reach agreement on many controversial issues related to the provisions of the dumb. The plan of this research included an introduction, three topics and a conclusion. As for the introduction: I  mentioned  the importance of this topic and the problem of the study and previous efforts in this matter. In the first topic, I talked about the concept of sign language in three demands and in the second topic, I talked about the importance of sign language, its history and its controls in three demands. In the third topic, I talked about the effect of sign language on the jurisprudence of the dumb in two requirements. In the conclusion, I summarized The most important results that I reached through the research.
